Principles governing the processing of personal data

Xsteam Europe recognises the importance of data protection and privacy of its customers personal data and will treat the personal data of these data subjects with due care and only for specified purposes.

Xsteam Europe explicitly confirms that all personal data will be processed in accordance with both the Belgian law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data and the Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter GDPR).

What personal data does Xsteam Europe collect and process?

It concerns the personal data that you, as a customer, communicate to Xsteam Europe and which Xsteam Europe needs to carry out the sale of the products, such as:

- surname and first name

- address

- email address

- telephone number

- if applicable: company name and VAT number

- if applicable: current occupation

Why does Xsteam Europe process this personal data?

This personal data is processed by Xsteam Europe for the purposes of customer management, selling its products, offering wholesale programs, complying with its administrative obligations and keeping its legally required accounts. If the client gives consent, Xsteam Europe will use personal data to send newsletters relating to its products.

What are the grounds for the processing of personal data by Xsteam Europe?

Xsteam Europe processes your personal data based on the contractual relationship it has with you as a result of your order and the contract Xsteam Europe concludes with you, and to comply with a statutory obligation.

If Xsteam Europe wishes to use your e-mail details to send you newsletters, it will always ask for your prior consent.

Are personal data disclosed to third parties?

Xsteam Europe does not sell your personal details to third parties and only provides them if necessary for the performance of the agreement concluded with you as a client, or to comply with a statutory obligation. Xsteam Europe will enter into a processing agreement with companies that process your personal details on Xsteam Europe's instructions in order to ensure the same level of security and confidentiality for your personal details. 

Are your personal data transferred outside Europe?

Your personal data will not be transferred to third countries, i.e. countries that are not part of the European Economic Area (which is formed by the European Union, together with Iceland, Norway and Liechtenstein).

How long does Xsteam Europe keep your personal data?

Your personal data will be kept in a manner consistent with applicable data protection laws. In any event, your personal data will not be kept longer than necessary to fulfil the purposes set out in this Policy.

In particular, Xsteam Europe:

- keeps your personal data concerning your subscription to the newsletter for three years from the time of your subscription to the newsletter;

- keeps your personal data concerning the transactions for the period set at 7 years after the completion of the relevant transaction

unless:

the processing of your personal data is required in connection with any actual or potential dispute (e.g. Xsteam Europe needs this personal data to bring or defend legal claims), in which case Xsteam Europe will retain your personal data until the end of such dispute; and/or

the retention is necessary for Xsteam Europe to comply with any legal or regulatory obligation (e.g. for tax purposes), in which case Xsteam Europe will retain your personal data for as long as required by that obligation.

You can exercise these rights by sending an e-mail to info@xsteameurope.com with proof of your identity. This will prevent Xsteam Europe from disclosing your personal data to anyone who is not entitled to do so.

Xsteam Europe will make all reasonable and practical efforts to comply with your request, provided that this is in accordance with applicable law.
